1. Acceptance

By using this website or subscribing to RackSanity updates, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the website or submit information.

2. Update list and communications

Subscribing to updates does not guarantee software access, product availability, a release date, pricing, or eligibility to purchase RackSanity. We may limit, pause, or change prerelease distribution at our discretion. You may unsubscribe from promotional or development emails at any time.

3. Prerelease and beta software

Any prerelease version of RackSanity may be incomplete, contain errors, change without notice, or cause data loss or interruption. Use beta software only for evaluation, maintain backups of important work, and do not rely on it for critical production or live-performance use.

Beta access may be subject to additional license terms presented with the software. If those terms conflict with these website terms regarding use of the software, the software license terms control.

4. Third-party plugins and services

RackSanity is intended to host compatible third-party audio plugins. Those plugins are not included unless expressly stated, remain subject to their owners’ licenses, and may behave differently based on format, version, copy protection, system configuration, or vendor updates. References to third-party products do not imply endorsement or affiliation.

5. Intellectual property

The RackSanity name, website, software, designs, text, graphics, and related materials are owned by RTW Audio LLC or its licensors and are protected by applicable intellectual-property laws. These terms do not transfer ownership to you.

6. Acceptable use

You may not misuse the website; interfere with its operation or security; attempt unauthorized access; distribute malicious code; scrape the service in a way that causes unreasonable load; impersonate another person; or use the website in violation of law.

7. Feedback

If you voluntarily provide suggestions or feedback, you grant RTW Audio LLC a worldwide, perpetual, irrevocable, royalty-free right to use that feedback to develop, improve, and market RackSanity without restriction or compensation. This does not transfer ownership of your music, recordings, or other creative work.

8. Future purchases and licenses

Any future purchase may be processed by Lemon Squeezy as merchant of record and will be subject to the pricing, refund terms, checkout disclosures, and software license presented at the time of purchase. A purchase grants only the license rights expressly provided; it does not transfer ownership of RackSanity.

9. Disclaimers

To the fullest extent permitted by law, the website, update list, and prerelease materials are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, noninfringement, availability, or compatibility.

10. Limitation of liability

To the fullest extent permitted by law, RTW Audio LLC and its owners, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, profits, recordings, or business opportunities arising from use of, or inability to use, the website or prerelease materials.

Where liability cannot be excluded, RTW Audio LLC’s total liability relating to the free website, update list, or prerelease access will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

11. Changes and termination

We may update the website, these terms, or availability of update-list and prerelease access. We may suspend or terminate access when reasonably necessary for security, legal compliance, misuse, or protection of RackSanity and its users.

12. Governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute not subject to another written agreement will be brought in the state or federal courts located in Illinois, and each party consents to their jurisdiction, except where applicable consumer law requires otherwise.
